THIRD PARTY DATA PROVIDED BY THE INTERESTED PARTY As already mentioned above, in some parts of the Site, it is possible to insert text messages, visible to Hertz Srl, which could contain (voluntarily or not) personal data of other people. With respect to these hypotheses, the Interested Party must be considered an independent data controller, assuming all the resulting legal obligations and responsibilities towards the "interested third parties".
BROWSING DATA The computer systems and software procedures used to operate the Site acquire by default some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF THE PROCESSING The legal bases used by Hertz Srl to process personal data, according to the purposes indicated in the following Article 4, are the following:
Provision of the service/fulfilment of contractual obligations: processing for this purpose is necessary for the execution of the contract signed between Hertz Srl and the Data Subject and, therefore, to be able to provide the contractually agreed services. The provision of personal data for this purpose is not mandatory, but in its absence it will not be possible to provide any Service.
Legitimate prevailing interest of the owner: the processing is necessary to carry out checks and assessments on the results and progress of the contractual relationship, as well as on the risks connected to it (such as: truthfulness of the data provided, solvency even during the relationship and correct use of the product and services).
Legal obligations: processing for this purpose is necessary for Hertz Srl to fulfill any legal obligations. The personal data provided to Hertz Srl will be processed in accordance with applicable law, which may involve their storage and communication to the competent Authorities.
Promotional communications to its customers: the processing for this purpose is based on the legitimate interest of Hertz Srl to send marketing communications regarding the integration of products and services already purchased by our customers or the promotion of similar products and services. Legitimate prevailing interest of the owner: the processing of our customers' data, in this case, is necessary to improve the efficiency of products and services offered by Hertz Srl. To this end, Hertz Srl may send questionnaires regarding the level of satisfaction and market surveys, make telephone calls or chat sessions; such questionnaires/market surveys in general will be designed in such a way as to minimize the use of personal data.
Marketing: processing for this purpose is based exclusively on the consent of the interested party, which can be freely revoked at any time; the interested party may, at any time and free of charge, stop receiving these communications by writing to ecommerce@hertzsrl.it and without prejudice to the lawfulness of the processing during the period of validity of the same consent. Sending promotional offers to its customers: to send, via email, SMS, telephone, banner, instant messaging, through an operator, via post and through the official social pages of Hertz Srl (RSS, LinkedIn and YouTube), marketing communications, promotions and personalized content, provide targeted advertising, regarding products and services similar to those the Customer has already purchased.
Marketing: to send, to anyone who has previously given their consent, marketing communications, promotions and advertising, via email, SMS, by telephone, via banners, instant messaging, via an operator, via paper mail and through the official social pages of Hertz Srl (RSS, LinkedIn and YouTube), relating to the products and services of Hertz Srl and third parties.
In the cases referred to in the previous points, Hertz Srl is authorized to process personal data in accordance with the applicable data protection regulations, without the need to collect specific consent from the Data Subject. Processing for the purposes referred to in the previous points is necessary to be able to provide the services and, therefore, for the execution of the contract itself. The provision of Data to Hertz Srl for this purpose is not mandatory, but otherwise it will not be possible to provide any Service.
In relation to the purposes above, the interested party may object at any time and free of charge to their processing: in the event of revocation, the interested party will not be able to use the services specified above.
In the above cases, Hertz Srl will process the data only after obtaining the consent of the interested party. The provision of consent, as better specified in the previous art. 3 "Legal basis and mandatory or optional nature of processing", is not mandatory, and where given, the interested party is free to revoke it at any time without any consequences (other than no longer being able to receive marketing communications). RECIPIENTS OF PERSONAL DATA The personal data of the interested party may be sent to the subjects indicated below (“Recipients”):
Entities that typically act as data controllers, namely: natural persons, companies or professional firms that provide assistance and consultancy to Hertz Srl in accounting, administrative, legal, tax, financial, debt collection matters relating to the provision of the Services, mailing of advertising material or contractual communications, companies organizing training events, entities providing services for web meetings and training web seminars; a complete list of all data controllers can be requested by contacting the email address: ecommerce@hertzsrl.it
Subjects providing email services (mail sending platforms), delegated to also manage cancellation requests forwarded by users for the processing purposes referred to in the point above.
Persons delegated to carry out technical maintenance activities (including maintenance of network equipment and electronic communications networks).
Persons authorised by Hertz Srl to process personal data necessary to carry out activities strictly related to the provision of products/services; a legal obligation of confidentiality applies to said persons.
Affiliated/Group companies for administrative purposes.
Factoring companies, credit institutions, debt collection companies, credit insurance companies.
Professional Orders or Training Bodies accredited with such Orders.
Competent subjects, entities or authorities to whom it is mandatory to communicate personal data in order to comply with legal obligations, prevent abuse or fraud.
TRANSFERS OF PERSONAL DATA For purposes related to the execution of the contract, some data may be communicated to recipients located outside the EU Economic Area.
Hertz Srl ensures that the processing of personal data by these recipients occurs in compliance with applicable legislation. Indeed, transfers are carried out through adequate guarantees, such as adequacy decisions, Standard Contractual Clauses approved by the European Commission or other guarantees considered adequate. METHODS OF TREATMENT The processing of personal data is carried out by means of the following operations: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data.
Personal data are processed both on paper and electronically and/or automatically, through the use of a website hosted on the cloud managed by our company and located in Italy. The data will be processed in such a way as to guarantee continuous security and confidentiality. In compliance with European regulations and national laws on data protection, Hertz Srl has implemented specific procedures aimed at preventing unauthorized access to data, their improper or illicit use, as well as preventing the destruction or loss, even accidental, of the data itself.
Only duly authorized personnel may access data in the course of their work.
STORAGE OF PERSONAL DATA Personal data processed for the purpose of providing the service will be stored for the time strictly necessary to achieve the aforementioned purpose. In any case, since such personal data are processed to provide the products/services, Hertz Srl may store them for a longer period, in particular for as long as it may be necessary to protect the interests of Hertz Srl from possible liabilities relating to the supply.
Personal data processed for Marketing purposes will be retained by Hertz Srl until the consent given by the interested party is revoked. Once the consent is revoked, the data will cease to be used for such purposes, but may be retained in order to protect the interests of Hertz Srl from possible liabilities based on such processing.
Personal data processed for the purpose of sending promotional offers to customers will be retained by Hertz Srl until the interested party objects to the processing by writing to ecommerce@hertzsrl.it
Personal data processed for the purpose of fulfilling legal obligations will be retained by Hertz Srl for the period required by specific legal obligations or by applicable legislation.
Personal data processed for the purpose of preventing abuse/fraud will be retained by Hertz Srl for the time strictly necessary for the aforementioned purpose.
